PLAIN-LANGUAGE POLICIES

What you should know before using Nocaly

These policies explain how the service works, how paid features are billed and how we handle your information. The English version is the controlling version; translations are provided for convenience.

01 · PRIVACY

Privacy policy

Information we collect

We collect account details such as your name, email, language preference and password hash; the course files, notes and instructions you choose to upload; generated study materials and video history; usage, device and security logs; and messages you send to support. We do not ask you to upload passwords, payment-card details, government identifiers, health records or other unnecessary sensitive information.

How we use it

We use this information to operate your account, create requested study materials and videos, provide support, protect the service, measure allowances, improve reliability and comply with law. We do not sell personal information or use private course content for advertising.

AI and service providers

When you request AI features, the relevant course content and instructions may be sent to contracted AI and cloud providers. Nocaly currently uses providers such as Google Cloud, OpenAI and Resend. Processing may occur outside Australia. Providers receive only the information reasonably needed to deliver their service and are subject to their own security and contractual controls.

Storage, retention and security

We use access controls, encrypted connections, restricted secrets and operational monitoring. No online service can guarantee absolute security. We retain account information while your account is active and as reasonably required for security, dispute resolution and legal obligations. You can export your account data or permanently delete your account from Settings. Backups and security logs may take a limited period to expire.

Your choices

You can update your language, change your password, export your data and delete your account. For access, correction or privacy concerns, use the support route below. We aim to follow the Australian Privacy Principles as a privacy-by-design standard, whether or not every provision legally applies to the business at its current size.

02 · TERMS

Terms of use

Accounts and eligibility

You must provide accurate information, keep your login secure and be legally able to accept these terms. Nocaly is intended for students aged 16 or older. A parent or guardian must approve use where local law requires it.

Your content

You keep ownership of content you upload. You give Nocaly a limited permission to host, process, reproduce and transform that content only as needed to provide, secure and improve the features you request. You must have the right to upload the material and must respect copyright, confidentiality and your institution’s rules.

AI limitations

AI output can be incomplete, outdated or wrong. Nocaly is a study aid, not a substitute for lectures, source materials, professional advice or your own judgment. Check important claims, calculations, citations and assessment requirements before relying on output. We do not guarantee grades, admission or academic outcomes.

Paid plans and Credits

The checkout page identifies the product, price in Australian dollars, billing frequency, included allowances and material limits before you pay. Student, Plus and Pro are monthly subscriptions that renew automatically each month until cancelled. By subscribing, you authorise the recurring charge shown at checkout. You can update or cancel a subscription through the billing portal. Cancellation stops the next renewal and paid access continues until the end of the current billing period. Upgrades can take effect immediately with a prorated charge or credit; downgrades take effect at the next billing period.

Credits are a one-time purchase for eligible usage-based features. They are not a subscription, are not transferable or redeemable for cash, and do not expire while the purchasing account remains active. The required number of Credits is shown before a generation begins. Credits held for a generation are automatically restored if that generation fails or is cancelled before successful delivery.

Acceptable use

Do not use Nocaly to break the law, invade privacy, distribute malware, bypass security, overload the service, impersonate another person, submit generated work dishonestly, or upload content you are not entitled to use. We may limit or suspend access to protect users and the service.

Availability and changes

The service is under active development. Features may change, fail or be withdrawn. We will take reasonable care but cannot promise uninterrupted availability. Material changes to paid features or these terms will be communicated before they take effect where reasonably practicable.

Consumer rights and responsibility

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees. To the extent permitted by law, Nocaly is not responsible for indirect loss, lost grades, missed deadlines or decisions made without independently checking AI output.

Governing law

These terms are governed by the laws of Victoria, Australia. Before formal proceedings, both sides should first try to resolve the concern in good faith through support.

03 · REFUNDS

Payments, cancellation and refunds

Clear monthly billing with self-service cancellation.

Subscription prices, renewal frequency and included allowances are shown before purchase. You can cancel through the Nocaly billing portal at any time before the next renewal.

When you cancel a monthly subscription, future renewal charges stop and your paid plan remains available until the end of the current billing period. We do not ordinarily provide a refund or credit solely because you change your mind or do not use the service. Unused purchased Credits remain on an active account and are not ordinarily refundable for change of mind.

If the service has a major problem, is materially different from its description, cannot be supplied, or otherwise fails an applicable consumer guarantee, you may be entitled to cancellation, a full or partial refund, a remedy or compensation under Australian Consumer Law. These rights cannot be excluded by this policy. Contact support with the account email, payment date and a description of the issue so we can assess the appropriate remedy. Do not send payment-card details.

04 · ACADEMIC INTEGRITY

Use AI to learn, not to misrepresent

Nocaly is designed to explain concepts, organise materials, create revision aids and help you practise. Your university or school decides what AI assistance is allowed.

  • Check the rules for each subject and assessment.
  • Disclose AI assistance when required.
  • Verify facts, quotations and citations against original sources.
  • Do not use Nocaly in a closed-book exam or restricted assessment.
  • Do not submit generated text as your own work when that is prohibited.

You remain responsible for what you submit and for meeting your institution’s academic integrity requirements.

05 · CONTACT

Questions, privacy requests and complaints

Signed-in users can select Help in the Nocaly workspace to create a support request and receive a reference number. If you cannot sign in, use the password-reset link on the login page. Do not send passwords, API keys, payment-card data or confidential course content in a support message.

This plain-language policy is an operational summary and not legal advice. Independent review by a qualified Australian lawyer is recommended before paid public launch and after material business changes.
